Organizations and individuals supplying or supplying second-hand electrical equipment must be aware of the important legal obligations imposed on them by electrical safety legislation; as follows:

A person supplying or offering to supply second-hand electrical equipment must have a label attached to the equipment indicating that the equipment is second-hand.

A company, including major charities, that supplies or offers the supply of second-hand electrical equipment must also affix a label stating that the equipment is second-hand and that the equipment has been inspected and tested and meets the standard. Australian / New Zealand (AS / NZS) 3760 – Electrical Equipment Service Safety Inspection and Testing and AS / NZ 5761: 2005 – Electrical Equipment Service Safety Inspection and Testing – Pre-Sale Pre-Sale Electrical Equipment.

If the item does not meet the test criteria, the company supplying or supplying the second-hand electrical equipment must include a clear statement on the label that the equipment is second-hand, with the following additional words: WARNING DO NOT USE UNTIL REPAIRED. If the organization still wishes to sell the item in its defective condition, the provisions of AS / NZ 4701 – Requirements for household electrical appliances and equipment for reconditioning or recycling of parts will apply.
